Terms of Use — Firm Portal

1. Agreement to Terms

By accessing or using the firm portal, booking system, or any authenticated area of kmcintyre.com.au (collectively, the “Portal”), you agree to be bound by these Terms of Use together with our Privacy Policy. If you do not agree to these terms, you must not use the Portal. These Terms do not apply to browsing the public pages of the Site (which require no agreement to use).

2. Scope — What the Portal Is and Is Not

The Portal is a secure area provided to clients, instructing solicitors, and authorised contacts for the purpose of sharing documents, tracking matter progress, receiving notifications, and communicating practical information relating to your legal matter.

The Portal is not a channel for giving formal legal instructions, seeking urgent advice, or transmitting time-critical material unless otherwise agreed. Instructions must continue to be given in writing in the usual way. If a matter is urgent, contact us by telephone.

3. Access and Accounts

Portal access is invitation-only. We do not charge you a fee for access to and/or use of the Portal. You will receive login credentials (email address and a password you set) when we grant you access to a specific matter. You are responsible for:

• Maintaining the confidentiality of your password
• All activity that occurs under your account, whether or not you authorised it
• Notifying us immediately if you become aware of any unauthorised use, loss of your device, or other security incident
• Keeping your contact details (email and phone) up to date

We strongly recommend enabling two-factor authentication (TOTP) on your Portal account when prompted.

We may suspend or terminate your access at any time if we reasonably believe your account has been compromised, if your matter has concluded, or if you have breached these Terms.

4. Acceptable Use

You agree to use the Portal only for lawful purposes directly related to your legal matter. You must not:

• Attempt to gain unauthorised access to any part of the Portal, other users’ accounts, our systems, or our service providers’ systems
• Upload files containing viruses, malware, ransomware, or other harmful code
• Use the Portal to transmit unsolicited or unauthorised communications, including to our staff or to other users
• Interfere with or disrupt the Portal’s functionality, security, or other users’ access
• Share your login credentials with any other person, or permit another person to use your account
• Copy, reproduce, redistribute, or publish any content from the Portal (including communications from us or documents belonging to other parties) outside the context of your matter
• Upload material that infringes a third party’s intellectual property, breaches confidentiality, or is defamatory or otherwise unlawful
• Use the Portal in a manner that could bring us or your matter into disrepute

5. Features of the Portal

The Portal includes the following features, which we may change or remove from time to time:

• Document sharing — view and download documents we have made available to you on your matter
• Document upload — upload documents you wish us to consider. Uploads are first held in a temporary staging area, then transferred to a secure OneDrive folder for the specific matter
• Booking system — submit booking requests for conferences, mediations, and appointments; view and (within the permitted window) request changes to existing bookings
• Notifications — receive updates from us relating to your matter
• Notify Counsel messaging — send us a short written message within your matter
• Self-service delete window — you may delete a document you uploaded within 30 minutes of upload if you uploaded it in error

6. Document Upload — File Types and Size

You may upload documents for the purpose of your legal matter. Accepted file types include PDF, DOCX, XLSX, JPG, PNG, and MSG/EML (email files). The maximum individual file size is 200 MB. The Portal displays progress and confirms successful upload.

You are responsible for ensuring that any documents you upload do not infringe the intellectual property rights of any third party, and that you have authority to disclose their contents to us.

7. Intellectual Property

All content, design, code, and functionality of the Portal (excluding documents you upload and our communications with you about your matter) are the intellectual property of Kelly McIntyre, Barrister, or our licensors. You are granted a limited, non-exclusive, non-transferable licence to access and use the Portal solely for the purposes described in these Terms. Documents you upload remain your property (or that of the original rights holder) and are used by us only for the purposes of your matter.

8. Privacy and Confidentiality

Your use of the Portal is subject to our Privacy Policy, which forms part of these Terms. Communications and documents on the Portal that are for the dominant purpose of legal advice or actual or anticipated litigation are subject to legal professional privilege. The use of this site, the firm portal or practice management system does not waive legal professional privilege in any respect.

9. Availability and Maintenance

We will use reasonable efforts to keep the Portal available, but we do not guarantee continuous or uninterrupted access. The Portal may be temporarily unavailable due to scheduled maintenance, updates, third-party service outages (including our hosting and integration providers), or circumstances beyond our reasonable control. We will endeavour to provide notice of planned maintenance where practicable.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Portal is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted, error-free, or free from viruses or other harmful components.
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Portal.
• Our total liability to you for any claim arising from use of the Portal (as distinct from your engagement of us for legal services, which is governed separately) is limited to the fees (if any) paid by you for access to the Portal.
• Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.
• Our professional liability for the provision of legal services is limited by a Scheme approved under professional standards legislation and is not affected by these Terms.

11. Termination and Matter Lifecycle

Access to the Portal tracks the lifecycle of your matter:

• Active — full Portal access as described in these Terms
• Settled — work on the matter has concluded but accounts remain outstanding; access continues
• Closed — the matter and accounts are fully concluded; your Portal access to the matter is revoked

We may also suspend or terminate your access at any time if:

• You breach these Terms
• We reasonably believe your account has been compromised
• We cease to offer the Portal
• Other reasonable cause arises (for example, a retainer dispute)

Upon termination, your right to access the Portal ceases immediately. We retain your matter data in accordance with our Privacy Policy and professional record-keeping obligations.

12. Changes to These Terms

We may update these Terms of Use from time to time to reflect changes in the Portal, our practice, or applicable law. Material changes that affect your rights will be notified via the Portal or by email, and the “Last updated” date at the top of this page will be revised. Your continued use of the Portal after notification constitutes acceptance of the updated Terms.

13. Governing Law

These Terms of Use are governed by the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia. Nothing in this clause prevents you from applying to a tribunal or regulator with specific statutory jurisdiction (for example, the Queensland Civil and Administrative Tribunal or the OAIC).
